BARNARDO'S ABSEIL 2017 

 

Your participation in the Event (which is described in more detail on the participant registration page) is subject to these terms and conditions. By completing the registration process for the Event, including ticking the box at the end of these terms and conditions, YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT with us Barnardo Events Limited (company number 2270706) whose registered office is at Barnardo House, Tanners Lane, Barkingside, Ilford Essex IG6 1QG (“Barnardo Trading”), in relation to your participation in the Event.

We strongly advise you to read carefully all of these terms and conditions. However, YOUR ATTENTION IS PARTICULARLY DRAWN TO THE TERMS AND CONDITIONS UNDER THE HEADINGS "PARTICIPATION REQUIREMENTS", "FUNDRAISING REQUIREMENTS" and "LIABILITY".

 

  1. PARTICIPATION REQUIREMENTS
    1. In order to take part in the Event, you must have paid the entry fee ("Entry Fee") and otherwise properly completed the registration process and received an official e-mail confirming your registration. We shall not be legally bound unless and until we provide such official e-mail to you.
    2. You must register for entry to the Event prior to the date of your chosen Event (the “Event Date”). There will be no registration on the Event Date.
    3. You must be at least 16 years old to take part in the Event. If on the Event Date you are under the age of 18 you must provide a completed consent form (available for download from the Event registration page) from a parent or guardian and hand it in on the day of the Event, prior to participation.  You will also be required to be accompanied throughout the Event by [a responsible adult over the age of 18]. Proof of your identity and age will be required at the Event and you must bring these with you. You will not be allowed to participate if you do not meet these requirements.
    4. You (or, if you are under the age of 18 on the Event Date, your parent or guardian) must complete and on the Event Date hand in to the person/organisation retained by us to supervise the abseiling the applicable Abseil Disclaimer form as indicated on the Event registration page. 
    5. You must carefully study all pre-Event documentation provided for the purposes of the Event, and comply with any requirements stated in it.
    6. By registering for the Event, you confirm that you are in good health and that you are not aware of any condition that would affect your ability to participate in the Event or would or might increase the risks associated with your participation. Should this no longer be the case on the Event Date, you must fully disclose the relevant facts and circumstances to us or the person/organisation retained by us to organise or help organise the Event ("Organiser") at that time, before your participation in any abseil.
  2. ENTRY LIMITATIONS
    1. You may only enter yourself for the Event, and you may only enter once for the Event: double entries are not permitted.
    2. Your right to take part in the Event is not guaranteed, and is subject to availability and individual assessment.
    3. Except in accordance with clause (7)(b) below, you cannot transfer your entry to the Event to anyone else without our written permission. Such permission is in our absolute discretion.
  3. FUNDRAISING REQUIREMENTS
    1. You pledge to raise a minimum of £150 for Barnardo's, a company limited by guarantee with registered office at Tanners Lane, Barkingside, Ilford, Essex, IG6 1QG, registered in England with number 61625, registered charity numbers 216250 and SC037605), through your participation in the Event. Gift Aid payments will not count towards this amount but will instead be considered as over and above it.
    2. You must not raise money for any other person or organisation (whether or not charitable) through your participation in the Event.
    3. We encourage you to set up an online fundraising page using the service provided by JustGiving in order to raise funds for Barnardo's in connection with the Event. If we require, you must provide details of any such online fundraising that you undertake.
    4. You must keep details of the names and addresses of, and amounts donated or pledged by, all donors and provide such details to us on request.
    5. You must regularly pay to Barnardo's all money you collect in connection with the Event, directly to the Barnardo's bank account or by such other means as we may reasonably require. You must pay all money to Barnardo's within 30 days of receiving it.
    6. You must provide a breakdown of how the money was raised and return to us all used and un-used sponsor forms.
    7. In raising funds for Barnardo's in connection with the Event you will:
      1. comply with any fundraising guidance or advice that we may from time to time issue;
      2. use only lawful means to raise funds for Barnardo's and will not do anything that harms or is likely to harm Barnardo's reputation;
      3. make clear to all potential donors that you are raising funds for Barnardo's.
    8. Your fundraising must not include:
      1. raising funds by carrying out door-to-door or unsolicited collections;
      2. collecting in any public place;
      3. collecting on private property (including shops, pubs etc) without first obtaining a Barnardo's collectors' licence from Barnardo's and permission of the owner of the private property;
      4. conducting any raffle or lottery or putting on any public event without first contacting Barnardo's and taking any steps which Barnardo's require.
    9. Should Barnardo's require (e.g. because it has concerns about the manner of your fundraising, or possible adverse effects on its reputation), you will cease raising funds in connection with the Event. Barnardo's will notify you of any such requirement by e-mail or otherwise in writing.
  4. PAYMENT
    1. If your entry is accepted your Entry Fee is non-refundable except as otherwise provided in these terms and conditions or otherwise in our absolute discretion.
    2. If for any reason we are unable to collect your Entry Fee or are obliged to refund it, in whole or in part, we may cancel your entry.
  5. ACCREDITATION AND WITHDRAWAL BY US OR THE ORGANISER
    1. If at any time we or our Organiser discover that you are or should have been ineligible to participate in the Event we reserve the right to disqualify you and/or refuse you entry into the Event, without any refund of the Entry Fee.
    2. We reserve the right to disqualify you at any point on reasonable grounds and may take any appropriate action to enforce this right. Without limiting the scope of this right, we may disqualify you if: you fail fully to comply with these terms and conditions; you have behaved in a manner which, in our reasonable opinion, has adversely affected or is likely adversely to affect the safety or enjoyment of other participants; you use threatening, abusive or insulting words or behaviour or in any way provoke or behave in a manner which may provoke a breach of the peace; in our reasonable opinion or that of our Organiser you are or may be acting under the influence of alcohol or drugs; or you fail when required to produce adequate proof of identity or age.
    3. We reserve the right to remove you from the Event, either during or before it, on grounds of ill health, or any other reason (at our absolute discretion) that may render you unfit to safely complete the Event. You agree that you will not take part in the Event if you are suffering from any contagious illness and that you will immediately report any illness arising during the Event, to the abseil instructors.
    4. In the event that you do not arrive at your designated sign in time slot, we reserve the right to remove you from the Event without any refund of your Entry Fee.
  6. EVENT RULES
    1. We may, at any time before or on the day of your participation in the Event, issue rules of conduct relating to the Event ("Event Rules"). Any Event Rules will have binding force as if included in these terms and conditions.
    2. You must accordingly abide by all Event Rules.
    3. Event Rules may include, amongst other things, requirements concerning your age, your weight, appropriate clothing for the Event, use of safety equipment, intoxication and use of alcohol.
  7. WITHDRAWAL BY PARTICIPANT
    1. You may withdraw from participation in the Event, and obtain a full refund of your Entry Fee, within two weeks after payment of your Entry Fee. In order to do this, you must notify us by e-mail within this period, to events@barnardos.org.uk stating clearly that you wish to withdraw and putting the word WITHDRAWAL in the subject line of the e-mail. Withdrawals will not be accepted by any other means, including by telephone. After the expiry of such two week period, your Entry Fee will not be refunded upon withdrawal.
    2. Entries cannot be deferred to the following year or to any other event.
    3. You acknowledge that the refund scheme set out above is fair and reasonable, and that the monies we may retain in respect of any withdrawal or transfer represent a reasonable pre-estimate of our administrative costs and loss in each case.
  8. CANCELLATION OF/ALTERATION TO THE EVENT
    1. If the Event is cancelled because of circumstances beyond our reasonable control including, for example, any Organiser supervising the abseil deciding that conditions are unsafe, fire, storm, and/or flood, earthquake, explosion, acts of a public enemy, war, insurrection, terrorist act or threat of terrorist act, sabotage, epidemic, embargoes, strikes, the death of a leading member of the British Royal Family (whether or not similar to any of these examples, “Force Majeure”) you will not be entitled to any refund of your Entry Fee or compensation for costs of travel or accommodation or any other cost or loss you incur.
    2. We reserve the right to change the start time of the Event. We will give you as much notice as reasonably practicable of such change. No refund of your Entry Fee shall be made for any change in start time of the Event, provided the Event takes place on the Event Date.
    3. We reserve the right to change the Event Date. We will give you as much notice as reasonably practicable of such change. If you are unable to attend on the revised Event Date, then we will refund your Entry Fee provided you notify us in writing, within 14 days of our informing you by e-mail or otherwise in writing of the revised Event Date, that you are unable to attend on the revised Event Date. However you will not be entitled to any compensation for costs of travel or accommodation or any other cost or loss you incur.
    4. We reserve the right to amend the Event format, including changing the height of the abseil, in our absolute discretion or that of our Organiser engaged to supervise the abseil. If the Event format or height of the abseil is changed you will not be entitled to any refund and we shall have no further liability whatsoever arising from such change of format or height.
  9. LIABILITY
    1. We have engaged an Organiser with expertise in such pursuits to conduct the abseil for all participants in the Event. That Organiser will be responsible for providing all safety and other equipment for the abseil, for briefing participants and all aspects of the safe conduct of each abseil. We have no expertise in these matters and are not providing any equipment for any abseil. Accordingly, to the extent permitted by law, we assume no responsibility whatsoever in respect of any abseil, or for death, injury or other loss or damage arising out of or in connection with any abseil comprised in the Event.
    2. You acknowledge that abseiling is a mountaineering activity with a danger of personal injury or death and you voluntarily and fully accept and assume the risks and dangers associated with your participation in the Event.
    3. You irrevocably agree, to the extent permitted by law, to hold harmless, indemnify and reimburse us from and for any and all sums, costs, claims or expenses (including legal and professional fees) incurred, payable or paid by us to any person (including you and/or any of your insurers) in connection with any accident, loss, damage or injury (including death) arising out of your attendance at and participation in the Event or any part thereof.
    4. Our liability to you arising out of or in connection with the Event is excluded to the fullest extent permissible by law.
    5. We shall not be liable for indirect or consequential loss or damage arising out of or in connection with the Event.
    6. You acknowledge that personal accident and personal items insurance is your sole responsibility. We strongly advise you to obtain such insurance cover.
    7. We shall not be liable to you for any loss or damage of or to personal equipment or other personal property arising out of or in connection with the Event.
    8. We shall not be liable for any acts or omissions of any spectators or other third parties, including those of any Organiser.
    9. All provisions of these terms and conditions that have as their object or effect the exclusion or limitation of liability shall apply in respect of liability otherwise incurred on whatever legal basis, including breach of contract, negligence or otherwise.
    10. All provisions of these terms and conditions that have as their object or effect the exclusion or limitation of liability, and any indemnity by you of us, shall apply not only for our benefit but also for the benefit of Barnardo's and of all directors, employees and other persons connected with us or Barnardo's. Accordingly, all such persons may enforce such provisions as well as or instead of us.
    11. Nothing in these terms and conditions shall exclude or limit the liability of any person in negligence for death or personal injury, or otherwise in so far as exclusion or limitation of liability is void, prohibited or unenforceable by law. Accordingly, all provisions of these terms and conditions that have as their object or effect the exclusion or limitation of liability shall be read subject to this sub-clause.
  1. COLLECTION AND USE OF YOUR DATA
    1. You agree and consent to our using the personal details provided by you when registering for the Event (i.e. your name, date of birth, contact details, t-shirt size and emergency contact details), for the following purposes:
      1. Administration of the Event
        1. We require a record of your registration details, including third party emergency contact details, for internal administration purposes in order to administer the Event.
        2. For the purposes of Event administration, we may provide a copy of your registration details to third party Organisers engaged by us to facilitate the Event, including those providing the abseil.
        3. We do not anticipate holding any records of any medical information relating to you. In the event that it is necessary to do so, any medical information you provide may be shared with medical personnel or teams allocated to the Event strictly as required in order to decide whether it is suitable for you to undertake the abseil and/or in event of emergency. Any medical information provided by you shall be deleted within a reasonable time following the Event.
        4. Such information used for administration of the Event shall be deleted within a reasonable time following the completion of the Event unless you expressly agree in writing that we may use such information in relation to future events that we may organise which are staged within a reasonable time after the Event.
      2. E-mail/SMS communications with you
        1. We may use the  contact details submitted by you to send you information by e-mail and/or SMS relating to the Event.
        2. We may also use such data to send you information by e-mail and/or SMS relating to other events and any further categories of news and promotional information that you have requested when registering for the Event.
        3. You agree that we may send an e-mail or SMS notification to you following the Event inviting you to submit or renew your registration for any future events that we may organise.
        4. You agree that we or the Official Photographer of the Event may use your contact details to contact you post event regarding the purchase of participant photos from the Event.
    2. You agree to inform us of any changes to the information that you supplied when registering for the Event. In particular, you must inform us of any changes to your medical condition and contact details. To do so, please contact events@barnardos.org.uk as soon as known.
    3. We will not disclose any of your personal details to third parties, except as expressly stated above. You may at any time withdraw your consent to our sending you categories of e-mail and/or SMS communications by either: i) following the opt-out instructions provided in the relevant e-mail or SMS, or ii) by writing to us at Events Team, Barnardo's Head Office, Tanners Lane, Barkingside, Ilford, Essex IG6 1QG. Please note that due to e-mail/SMS production schedules you may still receive communications that are already in production. You acknowledge that a valid e-mail address or SMS contact number will be required at all times in order for you to receive important Event information.
    4. To have your personal details deleted from our database, you may write to Events Team, Barnardo's Head Office, Tanners Lane, Barkingside, Ilford, Essex IG6 1QG.
    5. Subject to your right to have corrected, or to request the deletion of, your personal details from our database, you acknowledge and agree that it is a strict condition of participation in the Event that all mandatory fields within your profile (as provided by you upon registration for the Event) are complete and correct at all times. These fields include, in particular, gender, first name, surname, date of birth, medical condition information and emergency contact details. You acknowledge and agree that this information is required by us in order to properly and safely administer and conduct the Event. Accordingly we reserve the right to refuse you entry to the Event if you request the deletion of such mandatory information from your profile, or provide false or incomplete information, or we have reasonable grounds to believe you have done any of these things.
  2. MISCELLANEOUS
    1. You agree that we shall have the full right to record and film your participation in the Event and to make use of third party material of your participation in the Event, including through the use of a body mounted device during the Event and to use such recording and film and your name and image (collectively, "Material") in advertising and promotional material in connection with the Event and future events that we may organise. You confirmed that the Material shall remain our property and agree that you will not be entitled to payment and/or compensation for the use of the Material.
    2. You must not engage in any form of “ambush marketing” at or in connection with the Event (ambush marketing is an activity which utilizes the publicity value of an event without having any official involvement or connection with the event) and shall not breach or infringe the rights of any sponsor or other party commercially associated with the Event, nor conduct unauthorized promotions or other commercial activity.
    3. If any provision of these terms and conditions is declared by any judicial or other competent authority to be in whole or in part void, voidable, illegal or otherwise unenforceable the provision or relevant part of it shall be amended so as to make it valid and enforceable whilst as nearly as possible achieving the original effect of it; or, if that is not reasonably practicable, it shall be severed from these terms and conditions; and in either event the remaining provisions shall remain in full force and effect.
    4. These terms and conditions apply to the exclusion of all others. To the fullest extent permitted by law, any terms and conditions that would otherwise be implied are excluded.
    5. In addition to us, Barnardo's may enforce against you any and all terms of the contract relating to your participation in the Event that incorporates these terms and conditions. All such terms are for the benefit of Barnardo's as well as us.
  3. LAW AND JURISDICTION
    1. These terms and conditions, and the contract of which they form part, shall be governed and construed in all respects in accordance with English law.
    2. Any claim or dispute arising out of or in connection with these terms and conditions or the contract of which they form part, or otherwise out of or in connection with your participation or intended participation in the Event, that is not settled by other means (for example, discussion and negotiation, or mediation) shall be subject to the exclusive jurisdiction of the courts of England.

DECLARATION

By ticking the box below, you:

  • confirm that you have read and understood these terms and conditions, and in particular those under the headings "PARTICIPATION REQUIREMENTS", "FUNDRAISING REQUIREMENTS" and "LIABILITY";
  • confirm that you are eligible to participate in the Event; and
  • agree that your participation in the Event shall be subject to these terms and conditions, and that you will comply with them.
